Firefly Mobile, Inc. respects and protects the privacy of the kids and adults who use our web site. We comply fully with Children's Online Privacy Protection Act of 1998.
We've designed our site so that you can access most of it without giving us any information at all. Information about our products and services are simply available for you to view anonymously. Obviously, though, when you ask for information or services from Firefly Mobile, we need to know where to deliver it. So, when you set up a Firefly Mobile account, we'll collect information from you. We'll protect that information with a user name and password that's unique to you, and we won't share it with anybody else unless we're required to do so by law.
Whenever it's possible, Firefly Mobile limits the information we collect to what's called "non-personally identifiable information" which includes stuff like screen name, gender, birthday, state, zip code, and country. We don't want kids to give us any unnecessary information about themselves, and we don't make providing unnecessary information a requirement for any of our online activities. We might use "non-personally identifiable information" to hold special contests or promotions or to conduct surveys to find out what our customers like, and what we can do better. Firefly Mobile doesn't knowingly collect ANY personally identifiable information from kids under 13. If we ever want to know what kids under 13 think, we'll first notify their parent via email that we want to collect information, let the parent know that their consent is required before we get any information, and tell the parent how he or she can give or deny such consent. When someone 13 or under volunteers personally identifiable information to us, we will ask for a parent's email address so we can tell the parent that we've received information from the child. Then we'll give the parent a chance to tell us it's ok to get their child's information or to tell us to remove their child's information from our records.
If an adult uses a credit card to purchase our products online, Firefly Mobile will also collect the information we need to process that order. But we won't store any credit card information, other than to process that order.
Whenever we collect information from you on this site, we'll let you know why we need it. So, for example, if we have a contest, we might use the registration information we collect to notify contest winners. Occasionally, and only if and when you agree, we might also email or regular mail you to provide information on upcoming products, services, newsletters, web site updates and promotions. Firefly Mobile might also look at the way our customers use this site to improve it. So, for example, if multiple customers experience the same problem on the web site, we'd use that feedback to improve the site's performance. Most of this type of information is looked at together, or "in the aggregate." That means we don't separate out anyone's individual data and so everybody stays anonymous. Like we said, we won't share your individually-derived data with anyone.
In very special circumstances, Firefly Mobile may give other companies access to our information database, but only if they need that information to provide database or server maintenance or security, help us process and fulfill orders or requests, or provide other similar services to Firefly Mobile. If we do provide access, we require the companies we work with to sign confidentiality agreements promising to keep the information they see secret.
Of course, if Firefly Mobile believes that anyone's behavior on our site is dangerous to us or any of our subscribers, we'll disclose the relevant personal information to prevent harm. If something like that happens, we might try to identify the wrongdoer, contact them, or bring legal action against them. We may also disclose personal information if it's required by law. If Firefly Mobile is sold or transfers its assets, our customers' information may be shared with the receiving party. We promise not to use or transfer personally identifiable information of children in any other ways without their parent's consent.
Firefly Mobile will send email messages to customers who give us their email addresses. If you don't want Firefly Mobile to send you email or regular mail about our products and/or services, you can "opt-out" (or say "no, thanks").. If you get emails or regular mail from us and then later decide to opt-out and have your name removed from Firefly Mobile's mailing list, you just need to let our Privacy Manager know at the contact information below. Remember, though, even if you opt out of promotional emails, Firefly Mobile might still need to send you email messages about your account, the status of the site, or important product information.
Firefly Mobile may also use a software technology called "cookies" when you use our web site. Cookies are text files sent from our server to your computer's hard drive. They don't damage user files or read any information from your hard drive. Cookies just "remember" what you've done with Firefly Mobile before. That lets us personalize your experience on our site and save your preferences. Cookies also allow for faster access to certain pages. Cookies themselves do not contain any personally identifiable information.
Firefly Mobile has put in place physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online. As a result, encrypted connections may be used for some of our services, especially online product ordering and examining personal data. We may encrypt some of our data during transmission to or from your computer, and we will generally not inform you if we use additional encryption. It's possible that some of our services may not be available if your access to the Internet is filtered by a firewall or proxy server.
Keep in mind that if you stop using a particular email address, somebody else could start using it. If this happens, email sent to you at the old address could be received by unauthorized parties (the same thing could happen if you moved from one house to another and mail was delivered to your old address). Remember, you are responsible for letting us know if you change email accounts. If you don't, Firefly Mobile assumes no liability for misdirected messages that could reveal your personal information, including your account password, to someone else.
Our Privacy Manager will be glad to give you a summary of any personal information we have about you. You can change, correct, or update your personal records from our database online via My Account or by letting Firefly Mobile's Privacy Manager know at the email address listed below. Firefly Mobile will only send personal records to the email address we have on file for the user name associated with it.
Parents can also contact Firefly Mobile's Privacy Manager (contact information provided below) if they want to do any of these things:
Access the personally identifiable information we've received online from their child; Correct factual errors in that information; Request to have this information deleted; or Request that we no longer collect or maintain such information.
Firefly Mobile asks parents to please provide an email address and telephone number when you make a request like this. We will take reasonable steps to verify your identity before giving you access to any personal information we've collected about your child.
From our site, you might be able to access the web sites of third parties whose information and privacy practices are different from ours. You should consult the privacy policies of these sites before using them.
